These terms apply to quotations, bookings and services supplied by Amuloma Nexus Shipping (“we”, “us”). By instructing us, you accept them.
Quotations
Quotations are itemised, valid for fourteen days and based on the cargo, volume, weight and routing described at the time of enquiry. Changes to any of these, or to carrier surcharges, terminal charges, duty rates or exchange rates, may require re-quotation. Storage beyond any free period stated in the quote is billed separately.
Your obligations
- Provide accurate cargo descriptions, values, weights and the full document set before cut-off
- Declare dangerous, temperature-sensitive or restricted goods in writing in advance
- Hold the necessary permits and licences for controlled imports
- Pay agreed charges by the due date on the invoice
Our obligations
We book, document and clear with reasonable skill and care, and we keep you informed at each milestone. We are a forwarder, not a carrier: ocean and air carriage is performed by third-party operators under their own bills of lading and airway bills, and their liability limits apply.
Liability
Our liability for loss or damage is limited to the lower of the value of the affected cargo or the applicable package limitation in the governing carriage convention. We are not liable for loss arising from force majeure, port congestion, industrial action, carrier delay, or from inaccurate documents supplied to us. Full cover requires marine cargo insurance, which we can arrange on request.
Charges and lien
Invoices are payable within the terms stated. We hold a general lien over cargo and documents in our custody for unpaid charges relating to that cargo, and may recover storage and enforcement costs.
Storage and collection
Cargo must be collected within the free period quoted. Thereafter storage accrues daily. Cargo uncollected after ninety days may be sold to recover charges after written notice to the address on file.
Claims
Damage or shortfall must be notified in writing within three days of collection, with photographs and the delivery receipt annotated at the time. Claims for non-delivery must be notified within fourteen days.
Governing law
These terms are governed by the laws of Sierra Leone and the courts of Sierra Leone have exclusive jurisdiction.
